We, PORTFOLIO FASHIONS PRIVATE LIMITED, are a company incorporated under the Companies Act, 1956/2013 with CIN – U74994MH2006PTC159118, having our registered office at Jindal Mansion, 5A, Dr, G. Deshmukh Marg, Mumbai – 400 026.  (hereinafter referred to as the “ “We”/ “Us / Our”, which expression shall unless it be repugnant to the context or meaning thereof be deemed to mean and include its successors-in-title and assigns) and have formulated this Privacy Policy in relation to the use of our on-line services / platform/s (“Services”).

1.1.For the purpose of this Privacy Policy, wherever the context so requires "You", “Your” or “User” shall mean any natural or legal person who uses the Services for availing the Services. 

1.2.This document is an electronic record in terms of (i) Information Technology Act, 2000; (ii) the rules framed there under as applicable; and (iii) the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. 1.3.This Privacy Policy (“Privacy Policy”) is published in accordance with: (i) Section 43A of the Information Technology Act, 2000; (ii) Regulation 4 of the Information Technology (Reasonable security practices and procedures and sensitive personal information) Rules, 2011 (“SPI Rules”); and (iii) Regulation 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011, that require publishing the privacy policy that is applicable in relation to the access or usage of our Services.

1.4.This Privacy Policy covers: (i) the type of information collected from the users through the Services including sensitive personal data or information; (ii) the purpose, means and modes /of usage of such information; and (iii) how and to whom such information which has been collected will be disclosed.

2.1.For the purpose of this Privacy Policy, “personal information” as defined under Section 2(i) of the SPI Rules means, any information that relates to a natural person, which, either directly or indirectly, in combination with other information available or likely to be available with a body corporate, is capable of identifying such person.

2.2.“Sensitive personal information” as defined under Section 3 of the SPI Rules means such personal information which consists of information relating to:

b. financial information such as Bank account or credit card or debit card or other payment instrument details ;
c. physical, physiological and mental health condition;
d. sexual orientation;
e. medical records and history;
f. biometric information;
g. any detail relating to the above clauses as provided to body corporate for providing service; and
h. any of the information received under above clauses by body corporate for processing, stored or processed under lawful contract or otherwise.

2.3.We require Customers who avail our service to provide us with the following information:

a. Name of the Customer
b. E-mail Address
c. Phone Number
d. Address
e. Credit card or debit card information which is required for payment purposes.
f. Demographic information such as postcode, preferences and interest
g. All other information as required by Us to register/ provide the Service to the Customer.

2.4.We require the Vendors who avail our Services to provide us with the following information:

a. Name of the Vendor
b. E-mail Address
c. Phone Number
d. Postal Address
e. Tax-Payer Identification Number
f. All other information as required by Us to on-board the Vendor.

3. How the collected information will be used

3.1.Sensitive Personal Information and other information collected in terms of Clause 2 shall be used in the manner described below: 

  • Registered user name: The registered user name shall be used to customize the Services availed by the user and to personalize all communications that are sent to the user by us. 
  • E-mail Address: Your E-mail address will be used to communicate:
  1. Confirmation of your order booking;
  2. Details regarding payment for the orders placed;
  3. Feedback from customers regarding the products and services provided by us;
  4. Communication of delivery of orders placed by you.
  • Phone Number: Phone number will be an alternative method to contact the user for any matter related to the Services to be availed by you.
  • Address: The address can either be your residential address or official address or the address of the receiving party to whom the consignment is transported. The same shall be provided to the driver of the vendor carrying the consignment in order to deliver the consignment at the location specified by the user of out Services. 
  • Credit Card/Debit Card information: 

    a. Credit Card/Debit Card information is used for charging the user for making purchases by use of our Services.
    b. The Tax-Payer Identification Number collected from the Vendors shall be used to verify the Vendor and to generate an invoice.
    c. In order to improve the quality of our Services we may ask you to provide us with information regarding your experiences with our products and/or services. Users have the option of choosing not to provide us with this information.
    d. We will use your registered account transaction information which includes all information pertaining to your registered account activity, Products ordered, payments made, orders cancelled, modified and the like and communications pertaining to the same in order to assess the credibility of the user.
    e. We may use your information to send you promotional information pertaining to the Products and/or Services provided by us.
    f. We reserve the right to ask you, at the time of registration for our Services or thereafter, for documentary proof of your identity or other data or postings provided by you with respect to the registration or otherwise. In the event that you fail to provide us with this information or documentary proof, we reserve the right to refuse registration or to terminate your user agreement immediately and cease to provide any Services to you.

14.3.Services provided by Us only include provision of an online platform/s for facilitating buying and selling of Artworks and promotion of art, unless otherwise has expressly been provided in the Terms of Use. The products made available through the Services for sale are sold on ‘as-is’ basis and we have no responsibility with respect to adequacy, relevancy or authenticity of such products listed by other Users. 

15. Governing Law and Jurisdiction

The Privacy Policy shall be governed by and constructed in accordance with the applicable laws of India without reference to conflict of laws principles. Courts in Mumbai, India shall have the exclusive jurisdiction to determine any disputes arising in relation to, or under, this Privacy Policy.
